What’s Legal and What Isn’t
TELEHEALTH LAWS 2023

The state of Florida does not currently allow doctors to certify patients for medical marijuana treatment without an in-person examination. Any clinics who are seeing patients virtually are in direct violation of Senate Bill 8A. Specifically, the clause stating: 

“A qualified physician may issue a physician certification only if the qualified physician:
1. Conducted a physical examination while physically present in the same room as the patient and a full assessment of the medical history of the patient.”

If you or someone you know are under the care of a doctor who is performing telehealth appointments and therefore in direct violation of Florida law, please report them to the Office of Medical Marijuana Use (OMMU) via their complaint form.

In the future, should Florida law shift to allow for telehealth certifications, CannaMD will update this page accordingly.

TELEHEALTH EMERGENCY ORDER 2022

On October 5th, 2022, the Florida Department of Health released an emergency order in response to Hurricane Ian. This change made certain patients eligible to renew their marijuana certifications via telehealth appointment. 

The order expired on November 30th, 2022.
