Where Can’t I Use Medical Marijuana in Florida?

Florida's Amendment 2, implemented by Senate Bill 8A, outlines certain restrictions on the use of medical marijuana. It is strictly prohibited on public transportation, in public places, at the patient's workplace (unless permitted by the employer), in state correctional institutions, on school grounds, in vehicles, aircraft, and motorboats. However, there are exceptions for the use of low-THC cannabis, defined as a cannabis plant with dried flowers containing 0.8% or less of THC and more than 10% of cannabidiol by weight.

While much has been made of Florida’s Amendment 2 medical marijuana privileges (implemented by Senate Bill 8A), there are also a number of restrictions. Below, CannaMD takes a closer look at where Florida residents can and cannot use medical marijuana.

Restricted areas

Medical marijuana use and/or administration is strictly prohibited in the following places:

  • On any form of public transportation *
  • In any public place *
  • In the patient’s place of employment (unless permitted by his or her employer)
  • In a state correctional institution
  • On the grounds of a preschool, primary school, or secondary school
  • On a school bus
  • In a vehicle
  • In an aircraft
  • On a motorboat *

Exceptions

Low-THC cannabis use is permitted in categories followed by an asterisk (*). According to Senate Bill 8A, low-THC cannabis is defined as:

A plant of the genus Cannabis, the dried flowers of which contain .8 percent or less of tetrahydrocannabinol (THC) and more than 10 percent of cannabidiol weight for weight.
